Education Requirements

Salesperson Licensing Requirements

A 30-hour course titled "Principles of Real Estate" is required before taking the license exam. The course must be approved by the Commission. It is available by classroom or home-study method.

The school will provide information on making a reservation for the licensure exam. Upon completion of the course, the school will issue a certificate which must be shown to the test center manager. Both parts of the license exam must be passed within 12 months of the course completion date. The application for license must be received by the Commission within 4 months of the date the exam is passed. If parts of the exam are passed on different dates, the 4 month limit applies to the earliest date.

If a salesperson applicant is eligible for licensure through reciprocity or equivalent requirements met in another jurisdiction, the pre-license course is not required.

Salesperson Post License Requirements

A 30-hour course titled "Salesperson's Post-License Course", approved by the Commission, must be taken by nonresidents as well as Kansas residents. The course is available by classroom or by home study.

The course must be completed after issuance of the temporary license and at least 10 days prior to the temporary license expiration date.

Licensees must keep the certificate of course completion and send it to the Commission with the application to convert the temporary license to a standard license. The application to convert will be sent to the licensee's home address approximately 45 days prior to the license expiration date.

Broker Licensing Requirements

A 24-hour course titled "Broker's Pre-License Course" is required before taking the license exam. The course must be approved by the Commission. No continuing education credit is given for this course. It is available by classroom or home-study method.

The school will provide information on making a reservation for the licensure exam. Upon completion of the course, the school will issue a certificate which must be shown to the test center manager. Both parts of the license exam must be passed within 12 months of the course completion date.The application for license must be received by the Commission within 4 months of the date the exam is passed. If parts of the exam are passed on different dates, the 4 month limit applies to the earliest date.

If a broker applicant is eligible for licensure through reciprocity or equivalent requirements met in another jurisdiction, the pre-license course is not required.

Continuing Education Requirements

Continuing education hours and renewal of the license are due one month prior to the license expiration date. Expiration dates are staggered over a two-year period and are based on the first letter of the licensee’s last name. Courses must be completed within the current renewal period.

SALESPERSON

Salespersons must meet a 12-hour continuing education requirement for each subsequent two-year renewal after meeting the 30-hour post-license requirement.

BROKER

Brokers must meet a 12-hour continuing education requirement by their first renewal date and at each subsequent two-year renewal.

Courses must be approved by the Commission and completed within the current renewal period (see Staggered Renewal Schedule). Courses are available by classroom or home-study method.

Mandatory Hours

For salespersons, the 12 hours required must include at least 3 mandatory core hours (no more than 9 can be elective hours). The mandatory course is titled "Required Salesperson and Broker Core" (course code "M").

For brokers, at least 6 of the 12 hours must be mandatory core hours (no more than 6 can be elective hours). Brokers must complete 2 mandatory courses, titled "Required Salesperson and Broker Core" (course code "M") and "Required Broker Core (course code "MB").

The "Required Broker Core" covers one, or a combination of, the following six topics:

  1. Procedure Manuals
  2. Trust Accounts
  3. Management, including all facets of supervising a real estate company
  4. Common violations of the license act and BRRETA
  5. Commercial sales and leasing issues
  6. Farm and ranch issues

Course codes reflect the type of course:
E - Elective
M - Mandatory for both salespersons and brokers
MB - Mandatory for brokers (elective for salespersons)
A - Appraisal (Limited to one appraisal course per renewal period)

Reciprocity:

Education And Licensure In Another State

A Missouri Core class might count for elective hours, but not for Kansas mandatory hours.

A few providers in the Kansas City area have submitted the course and received approval because the course compares Kansas and Missouri law. The provider, in these cases, will submit to the Kansas Real Estate Commission a roster of course attendees and elective credit will be entered on your record from the roster.

58-3040. Nonresident license.

  1. A nonresident of this state may be granted a broker's license if:
    • The nonresident is licensed as a broker in the nonresident's state of residence; and
    • such nonresident meets all requirements imposed by this act on Kansas residents for licensure as a broker, except that the Commission may waive the education provided by subsection (b) of K.S.A. 58-3046a and amendments thereto, the examination provided by K.S.A. 58-3039 and amendments thereto and the experience provided by subsection (c) of K.S.A. 58-3039 and amendments thereto for a nonresident who, in the judgment of the Commission, has received equivalent education, has passed an equivalent examination and has obtained equivalent experience.
  2. A nonresident broker employed by or associated with a broker licensed pursuant to this act may be granted a broker's license under such broker, if:
    • The broker is licensed as a broker in the broker's state of residence; and
    • such broker meets all requirements imposed by this act on Kansas residents for licensure as a broker, except that the Commission may waive the education provided by subsection (b) of K.S.A. 58-3046a and amendments thereto, the examination provided by K.S.A. 58-3039 and amendments thereto and the experience provided by subsection (c) of K.S.A. 58-3039 and amendments thereto if, in the judgment of the Commission, the broker has received equivalent education, has passed an equivalent examination and has obtained equivalent experience.
  3. A nonresident salesperson employed by or associated with a broker licensed pursuant to this act may be granted a salesperson's license under such broker, if:
    • The salesperson is licensed as a salesperson in the salesperson's state of residence; and
    • such salesperson meets all requirements imposed by this act on Kansas residents for licensure as a salesperson, except that the Commission may waive the education provided by subsection (a) of K.S.A. 58-3046a and amendments thereto and the examination provided by K.S.A. 58-3039 and amendments thereto if, in the judgment of the Commission, the salesperson has received equivalent education and has passed an equivalent examination.
  4. The Commission may enter into agreements with other jurisdictions as to the issuance of reciprocal licenses.
  5. The Commission may waive the education provided by subsection (b) of K.S.A. 58-3046a and amendments thereto, the examination provided by K.S.A. 58-3039 and amendments thereto and the experience provided by subsection (c) of K.S.A. 58-3039 and amendments thereto and issue an original broker's license to a Kansas resident who holds a broker's license issued by another jurisdiction if, in the judgment of the Commission, the applicant received equivalent education, passed an equivalent examination and obtained equivalent experience. The applicant shall meet all other requirements imposed by this act.
  6. The Commission may waive the education provided by subsection (a) of K.S.A. 58-3046a and amendments thereto and the examination provided by K.S.A. 58-3039 and amendments thereto and issue an original salesperson's license to a Kansas resident who holds a salesperson's license issued by another jurisdiction if, in the judgment of the Commission, the applicant received equivalent education and passed an equivalent examination. The applicant shall meet all other requirements imposed by this act.
  7. Prior to the issuance of a license to a nonresident, the applicant shall file with the Commission a designation in writing that appoints the director of the Commission as the applicant's agent, upon whom all judicial and other process or legal notices directed to the applicant may be served in the event such applicant becomes a licensee. Any process or legal notices to a nonresident licensee shall be directed to the director, accompanied by a fee of $3, and, in the case of a summons, shall require the nonresident licensee to answer within 40 days from the date of service on such licensee. A summons and a certified copy of the petition shall be forthwith forwarded by the clerk of the court to the director, who shall immediately forward a copy of the summons and the certified copy of the petition to the nonresident licensee. Thereafter, the director shall make return of the summons to the court from which it was issued, showing the date of its receipt by the director, the date of forwarding and the name and address of the person to whom the director forwarded a copy. Such return shall have the same force and effect as a return made by the sheriff on process directed to the sheriff.
  8. Prior to the issuance of a license to a nonresident, the applicant must agree in writing to abide by all provisions of this act with respect to the applicant's real estate activities within the state and submit to the jurisdiction of the Commission and the state in all matters relating thereto. Such agreement shall be filed with the Commission and shall remain in force for so long as the nonresident is licensed by this state and thereafter with respect to acts or omissions committed while licensed as a nonresident.
  9. A nonresident licensed under this section shall be entitled to the same rights and subject to the same obligations as are provided in this act for Kansas residents, except that revocation or suspension of a nonresident's license in the nonresident's state of residence shall automatically cause the same revocation or suspension of such nonresident's license issued under this act. No hearing shall be granted to a nonresident licensee where license is subject to such automatic revocation or suspension except for the purpose of establishing the fact of revocation or suspension of the nonresident's license by the nonresident's state of residence.

Reporting

Student Reporting Requirements

Within ten days following the completion of other than an alternative delivery method course or correspondence course, a school shall provide the commission with a class roster in a format approved by the commission. For an alternative delivery method course or correspondence course, a school shall provide a roster of those students completing the course within 10 days after the end of the month in which the student completed the course. The listing of students must be numbered and in alphabetical order, with each student's last name shown first, and must show after each student's name the final grade of either passed, failed, incomplete, or dropped, in language or symbols that can be correlated with these categories. The school shall explain any other grade concisely but clearly. The school shall list all instructors used in the course on the roster.

Case Management Procedures For Continuing Education

If the school cancels a course, the school shall fully refund all fees collected from students or, at the student's option, the school may credit the student for another course. The school shall inform the commission when a student requests a refund because of a withdrawal due to the student's dissatisfaction with the quality of the course.

A school shall issue to the students successfully completing a course of instruction an official certificate which reflects the school's name, branch, course title, course numbers, and the number of classroom hours (or other recognized educational unit) involved in the course. All core course certificates must show the statutory core course title or other identification as prescribed by the commission. Certificates also must show the date of issuance and be signed by an official of the school, or if the certificate is computer printed, the school logo may be substituted for the signature.

A school shall maintain records of each student enrolled in any course for a minimum of five years.

Salesperson Reciprocity Applicants

All license applicants must pass the Kansas portion of the licensure exam for salespersons.

Applicants who hold a current salesperson's license in another jurisdiction do not have to complete Kansas' 30-hour pre-license course and the national portion of the examination IF the applicant has completed a course and examination for a jurisdiction the Commission has determined to have equivalent requirements.

The following items are required to apply:

  1. Passing score report for the Kansas portion of the licensure examination filed with the Commission within four months of the date the exam was passed
  2. Application for License as a Real Estate Salesperson by Equivalent Requirements Met signed by a supervising or branch broker who holds a Kansas broker's license.
  3. nonresident form if not a Kansas resident
  4. current certification of license from any jurisdictions that have issued a real estate license to you (For jurisdiction contact information go to www.arello.com)
  5. $15 nonrefundable application fee and $25 temporary license fee (a combined check for $40 payable to "K.R.E.C." is preferred)

A new salesperson is issued a temporary license which will expire on the last day of the sixth month following the last day of the month in which it was issued.

A temporary license may be converted to a standard salesperson's license with an effective date the day following the expiration date of the temporary license provided the licensee:

  1. takes the 30-hour "Salesperson's Post-License Course" after the issue date of the temporary license; and

at least 10 days prior to the temporary license expiration date, files the application to convert the temporary license to a standard license, the certificate of completion of the "Salesperson's Post-License Course" and pays the prorated license fee.

Broker Reciprocity Applicants

All license applicants must pass the Kansas portion of the licensure exam for brokers.

Applicants who hold a current broker's license in another jurisdiction do not have to complete Kansas' 24-hour broker pre-license course and the national portion of the examination IF the applicant has completed a broker pre-license course and examination for a jurisdiction the Commission has determined to have equivalent requirements.

Applicants must also demonstrate they meet the experience requirement for a Kansas license as follows:

  • Licensed as a salesperson in Kansas, or as a salesperson or broker in another jurisdiction, and ACTIVELY ENGAGED in activities which require a license in Kansas for at least two years during the last five years
  • Experience in the real estate or a related business or a combination of such experience and education may be accepted by the Commission as being equivalent to all or part of the experience as a licensed salesperson or broker if the Commission believes it qualifies the applicant to act as a broker. Only experience during the last five years will be considered. Experience will be evaluated on a case-by-case basis.
  • As of 3/9/07, the following jurisdictions have been determined to have equivalent experience for a broker's license.
  • Arizona
  • Delaware
  • Hawaii
  • Kentucky
  • Maine
  • Michigan
  • Montana
  • New Jersey
  • New Mexico
  • North Dakota
  • Ohio
  • Tennessee
  • Utah
  • Vermont
  • Virginia.
  • West Virginia

If the applicant is not applying as a supervising or branch broker, the applicant must be affiliated with a supervising or branch broker who has a Kansas broker's license.

The following items are required to apply:

  1. Passing score report for the Kansas portion of the broker's licensure examination filed with the Commission within four months of the date the exam was passed
  2. Application for Broker's License via Requirements Met in Another State
  3. nonresident form if not a Kansas resident
  4. current certification of license from any other jurisdictions that you are currently licensed in or have been in the past (For contact information for other jurisdictions go to www.arello.com) Certification must be less than four months old at the time your license application is filed.
  5. $15 nonrefundable application fee and prorated license fee (Link to Fee Schedule. One combined check is okay.

Note to applicants using Missouri Requirements: Applicants must request their pre-license course and examination information be included on the certification of license issued by the Missouri Real Estate Commission. If the Missouri license was obtained without completion of a pre-license course, the applicant must take the Missouri broker pre-license course or the Kansas 24-hour broker pre-license course, and include a copy of the certificate of completion with the application for license.

To request certification of a Missouri license, go to the web site for the Missouri Real Estate Commission, http://www.pr.mo.gov/realestate.asp. Click on Application Forms, and then print the Request for Certification of Licensure. Complete Part I and III of the form and send it to the Missouri Real Estate Commission with the $10 fee

Student Reporting Requirements

Submission of rosters to the Commission.

  1. Except as provided in paragraph (d) (5) of this regulation, each school shall submit a roster to the Commission within seven calendar days after the completion date of any course approved by the Commission. If the completion date is less than seven calendar days prior to any renewal date established by K.A.R. 86-1-4, the school shall postmark, deliver or FAX the roster to the Commission no later than the renewal date.
  2. The roster shall be on a form approved by the Commission and shall include the following:
    • the name of the school;
    • the school code;
    • the name of the course;
    • the course code;
    • the name of the instructor;
    • the city where the course was offered;
    • the number of hours approved for credit either as elective hours or as mandatory hours;
    • the date the course was completed;
    • the full name and license number of each licensee who attended the course and was issued a certificate pursuant to subsection (b) of this regulation; and
    • the total number of licensees listed on the roster.
  3. The school shall list licensees in alphabetical order on the roster.
  4. The school coordinator or the instructor shall sign each page of the roster.
  5. Any roster containing incorrect or incomplete licensee information may be returned to the school coordinator for correction and no credit hours may be entered into the Commission records for any such licensee until the licensee information is corrected and returned to the Commission.
  6. Any roster not in compliance with any other requirement of paragraph (2) above may be returned to the school and no credit hours entered into the Commission records until the roster is corrected and returned to the Commission.
  7. The school shall not submit a roster for any correspondence or home study program course or for any course registered, pursuant to K.A.R. 86-1-11, under the title ``Principles of Real Estate'' or ``Broker Pre-License Course.''

Each licensee's record is updated from rosters or home-study certificates supplied to the Commission by the school. Licensees should keep copies of the certificates, in their own records, as evidence of course completion.

Retain your Certificate of Completion in a safe place! DO NOT MAIL TO THE COMMISSION unless requested to do so. Schools will report your credit to the Commission within 7 days of the course or by the licensee's renewal date, whichever is sooner. To receive proper credit, please be sure the name and license number you supply to the school matches that shown on your license or pocket card.

CASE MANAGEMENT REQUIREMENTS

  1. Issuance of certificates to students.
    • Within seven calendar days of completion of the course, each school shall issue a certificate of completion, either in person or by mail, to each student who successfully completes a course approved by the Commission. Each school shall use certificate forms approved by the Commission.
    • The school shall not issue a certificate to any student who was absent more than 10 percent of the classroom hours scheduled for courses registered, pursuant to K.A.R. 86-1-11, under the title ``Principles of Real Estate,'' ``Broker Pre-License Course,'' or ``Salesperson's Post-License Course.'' The school shall not issue a certificate to any student who was absent during any portion of the scheduled classroom hours for any other course approved by the Commission pursuant to K.A.R. 86-1-11.
  2. Submission of certificates to the Commission.
    • Each school shall submit a copy of each certificate issued for completion of a correspondence or home study program course to the Commission within seven calendar days after course completion. If the course completion date is less than seven calendar days before the licensee's renewal date established by K.A.R. 86-1-4, the school shall postmark, deliver or FAX the certificate to the Commission no later than the renewal date.
    • Each certificate submitted pursuant to this paragraph shall include the word ``COPY'' in bold and conspicuous type in the upper right corner of the certificate.
