Education Requirements

Salesperson Licensing Requirements

In order to qualify for licensure as a real estate salesperson, an applicant must have satisfactorily completed a 45 hour salesperson qualifying education course in real estate approved by the Secretary of State, and have passed a qualifying examination administered by the Department.

Broker Licensing Requirements

In order to qualify for licensure as a real estate broker, an applicant must have at least one year of experience as a licensed real estate salesperson or at least two years of experience in the general real estate field (e.g., buying and selling your own property, managing property owned by your employer), have satisfactorily completed both the qualifying salesperson course of 45 hours and an additional 45 hour real estate broker course as approved by the Secretary of State, and have passed a qualifying examination administered by the Department.

Continuing Education Requirements

Real Estate licensees are required to successfully complete 22 ½ hours of approved continuing education within their two-year term prior to renewal of their license.

Update August 17,2007 - Any real estate licensee who renews their license on or after July 1, 2008 will be required to complete 22.5 hours of approved continuing education, three hours of which must include fair housing and/or discrimination in the sale or rental of real property or an interest in real property.

Exemptions from the continuing education requirement include:

  1. Attorney who holds a license and is admitted for the NYS Bar.
  2. A real estate broker who has 15 consecutive years of combined licensure as a salesperson and a broker and who is actively engaged in the real estate business at the time of renewal. Please note: A broker who fails to renew their license by the expiration date of that license, will lose their "consecutive years" and will no longer be exempt. The fifteen years will begin again with the new dates of licensure.

Continuing education courses have been set up in such a way that licensees will be able to select courses of study that will be helpful to them in their particular specialty. Subject matter varies from course to course. In an effort to provide availability of course work, courses can be completed either in a classroom setting or through a "computer based" program. These types of courses can be downloaded off the Internet or completed with the use of cd roms or diskettes.

Any salesperson who successfully completes an approved broker qualifying course (which requires passing the final exam) will receive credit for continuing education for their current two year sales license renewal period.

Education And Licensure In Another State

Arkansas- Broker only-two years licensure and current. (Business and Residence must be in Arkansas.)

Colorado- Broker and Associate Broker. Current licensure. (Business and residence addresses must be in Colorado). Colorado Associate Brokers must submit a salesperson application and $50 fee, along with their certification and irrevocable consent form.

Connecticut- Broker and Sales-current licensure only. (Business and Residence must be in Connecticut.)

Georgia- Broker and Sales-current licensure only (business and residence must be in Georgia). Must have obtained their license by passing Georgia exam.

Massachusetts- Broker only-two years licensure and current. (Business and Residence must be in Massachusetts.)

Mississippi- Broker and Salesperson-current licensure only (business and residence must be in Mississippi). Must have obtained their license by passing Mississippi exam.

Nebraska- Broker and Sales-current licensure only. (Business and Residence must be in Nebraska.)

Oklahoma- Broker and Sales-two years licensure and current. (Business and Residence must be in Oklahoma.)

Pennsylvania- Broker and Salesperson -current licensure only. (Business and Residence must be in Pennsylvania)

West Virginia- Broker and Sales-current licensure only. (Business and Residence must be in West Virginia.)

All need current certification (dated within six months, from the Real Estate Commission where license was obtained), completed application, irrevocable consent form, and the appropriate fee.

Applicants seeking a reciprocal real estate salesperson's license must be sponsored by their home-state broker who must hold a current New York State broker's license.

Applicants seeking a corporate real estate broker's license must file said corporation in the New York State Corporations Bureau at 41 State Street, Albany, NY 12231, as a foreign corporation.

Student Reporting Requirements

The school offering the program must provide evidence of successful completion of the course to each student in certificate form. The certificate must indicate the following: the name of the approved entity, the name of the course, the code number of the course, and that the student, who shall be named, has satisfactorily completed the continuing education course approved by the Department of State and the number of hours earned. The certificate must be signed and dated by the owner or course coordinator or other person offering the program; and the school or other person offering the program must submit to the Department of State within 15 days the names and license registration numbers of all individuals who successfully completed the approved course.
